(a)    Planning Applications

 

Planning Applications as circulated were noted by the members

 

(b)    Planning Application 09/10028 – Laura Doherty & Peter Loughlin.  Application for consent to carry out works on Council property to facilitate the proposed development.

 

Cllr. Dermot Doherty vacated the room.

 

The members agreed to the consent to carry out works on Council property to facilitate the proposed development by Laura Doherty & Peter Loughlin, this was proposed by Cllr. Mc Mahon, seconded by Cllr. Rafferty.

 

34/10            Consideration of proposals for 2010 Road Grant Allocation - €139,000

 

Mr. Murray confirmed that the allocation for Road Grant had increased from €126,000 last year.   He circulated a report to the members prior to the meeting with a list of proposed works to be carried out with the grant which included frost damage/patching repairs at various locations throughout the town which would cost approx. €20,000.

Other works included gullies, drainage etc. at Sea Road, Re-lining of road throughout the town, West End Walk completion works and the construction of a new footpath towards speed limit at Drumacrin Road.  He estimated the total cost of these works would be approximately €119,000. 

 

Cllr. Mc Glynn felt that the completion of the West End Walk was vital including the levelling of top soil etc.

 

Cllr. D Doherty asked what was happening in relation to the Bus Stops including the Ulsterbus shelter on the Astoria Road.

 

Mr. Murray confirmed that a newspaper advert would be placed in the local press advertising the sponsorship of the bus stops in the next few weeks.

 

Cllr. Mc Mahon was also annoyed at the delay in the completion of the West End Walk and asked what was the up to date position on the estate roads at Tullan Strand Road.  Mr. Mc Nulty confirmed that these roads had not been taken over and were private roads and that Mr. Murray would have a relook at this and come back to the members.

 

Cllr. Mc Eniff proposed that double yellow lines be placed on the right hand side roadway from the stables road down to Tullan Strand, this was seconded by Cllr. D. Doherty.

 

Cllr. Mc Intyre asked that the Take over of Estates needs to be put on the Agenda every month as it keeps coming up for the last 8 years as Work in Progress and it need to progress.  It was agreed that a report be available for next meeting.

 

It was unanimously agreed to have a Work Shop Meeting on Tuesday 27th April at 10:00 a.m.

 

Cllr. D. Doherty asked that signs for dog foul needs to be place at West End Walk.  Mr. Mc Nulty confirmed that the Council has purchased dog scoopers and signage for both walks which would be in place shortly.

 

35/10            Proposed amendments to Scheme of Letting Priorities

 

The proposed amendments to include the proposed Scheme of Letting Priorities was proposed by Cllr. Mc Intyre, seconded by Cllr. Mc Glynn.

 

With regards to Cllr. D. Dohertys motion at an earlier meeting to increase the local points from 5 to 20, Mr. Mc Nulty read correspondence received from the Department in relation to same which confirmed that they cannot approve same.  Cllr. D. Doherty asked what was flexible and to go back to the Department asking would 10 instead of 20 points be more flexible.

36/10            Tourism Officer Report

 

            The Tourism Report was circulated to the members prior to the meeting. 

 

            Cllr. Mc Eniff proposed that the Bundoran Town Council pay their contribution over the next few weeks as money was needed, this was seconded by Cllr. Mc Mahon.

 

37/10            Funding for Local Community Groups 2010

 

            The following funding was unanimously agreed by the members

 

            Bundoran Tidy Towns                                      €1,000

            Bundoran Community Childcare                                  €2,000

            Bundoran St. Patricks Day Parade (already agreed)€3,000

Cllr. Rafferty queried €10,000 for Childcare.  Mr. Sheridan confirmed that discussions were ongoing with the Childcare and Foroige.

 

38/10   Access to Tullan Strand

           

Mr. Sheridan confirmed that the progress they had made on this matter was no longer an option as the lands in question are in receivership.  The County Council are now left with the original option of the CPO or pursuing the matter with the receivers.

 

39/10            Motions

 

(a)            Submitted by Rafferty

 

(i)                “That this Council purchase a Defibrillator and that all Councillor’s be trained to use it”

 

Proposed by Cllr. Rafferty, seconded by Cllr. Mc Mahon

(ii)              “That this Council contact the relevant bodies to erect a railing from the St. Macartans National School to the Church Roundabout”

 

Cllr. Rafferty made an amendment to his motion that it is Magh Ene College as opposed to St. Macartans.

 

Proposed by Cllr. Rafferty, seconded by Cllr. Mc Eniff

 

Cllr. Doherty proposed that railing be placed on both sides of the road, Cllr. Mc Eniff felt that bollards would be sufficient.

 

It was agreed that Mr. Peadar Thomas and Mr. Liam Murray have a look at this.

 

(iii)           “That this Council put in place a system that when motions be passed, there is a monthly report on the progress”

 

Proposed by Cllr. Rafferty, seconded by Cllr. Mc Mahon.  Cllr. Mc Intyre proposed an amendment that a quarterly report would be appropriate.  This was unanimously agreed.

 

(b)            Submitted by Cllr. Barrett

 

(i)                “That this Council purchase a table for the Mayor’s Ball to be held on Friday 23rd April, 2010”

 

Proposed by Cllr. Mc Eniff, seconded by Cllr. D. Doherty

 

(c)            Submitted by Cllr. Mc Mahon

 

(i)                “That this Council give a full detail account of all their houses in stock and maintenance programme”

 

Proposed by Cllr. Mc Mahon, seconded by Cllr. Rafferty.  Liam Murray to have a report for next meeting.

 

(ii)              “That this Council give us a report on where the sewage scheme is at and a start up time”

 

Proposed by Cllr. Mc Mahon, seconded by Cllr. Mc Eniff.

 

Mr. Sean Sheridan informed the members that it was unlikely that the Scheme would proceed in the shorter term as it is not included in Capital Funding Projects approved for the next couple of years.

(d)            Submitted by Cllr. F. Doherty

 

(i)                “That this Council propose that the Town Engineer assess appropriate site location for the proposed new development of the Surfing Centre of Excellence”

(ii)              “That this Council zone as a Special Open and Green Space the area known as the Putting Green and Tennis Courts”

(iii)           “That this Council in the interest of orderly development and the creation of a pleasing façade review the protected structure list and forbid street art and graffiti on the external walls of these buildings”

(iv)             “That this Council suspend parking charges inside the urban area for the Summer Season 2010”

(v)               “That this Council build a skate board park as an amenity for the young people of the town”

 

As Cllr. F. Doherty was not present her motions could not be taken.

 

(e)            Submitted by Cllr. D. Doherty

 

(i)                “That this Council places bins on the new road beside the convent as soon as possible”

 

Cllr. Doherty was informed that this was a private roadway and that the owner was making arrangements to provide bins.

 

(ii)              “That this Council does not issue parking tickets before 11 a.m.”

 

Proposed by Cllr. D. Doherty, seconded by Cllr. Mc Mahon

 

Cllr. Mc Mahon voiced his concern that he had been lead to believe the Council had agreed that there be no parking charges only in July & August as we were trying to attract people to the town and a Workshop Meeting was to be held to discuss this and it never materialized.

 

(iii)           “That this Council petitions Galway County and City Council to erect more signs for Galway Hospital in order to deal with the increased number of patients travelling from Donegal and its surrounding areas”

 

Proposed by Cllr. D. Doherty, seconded by Cllr. Mc Eniff

 

(iv)             “That this Council takes charges of the Main Street and Church Road Roads as they are no longer National Primary Routes.

 

Proposed by Cllr. D. Doherty, there was no seconder for this motion

“That South Tipperary County Council requests the Minister for Health and Children, Ms. Mary Harney, T.D. to reverse the H.S.E.’s decision to centralize all medical card processing to the PCRS Offices in Dublin”

(g)            Submitted by Tullamore Town Council

 

“That Tullamore Town Council request information from the HSE regarding the assessment system in place for Medical Card Holders”

40/10            Questions

 

            (a)            Submitted by Cllr. Rafferty

 

(i)                 What progress has been made regarding signs at Doran Park regarding Childrens Safety?

 

Mr. Murray informed the meeting that this was going out for tender next week.

 

(ii)               What progress has been made regarding litter bins and signs for the Boat Quay and RNLI Station?

 

Mr. Peadar Thomas, Donegal County Council, agreed to provide bins at this location as long as Bundoran Town Council agree to empty them.

 

(b)              Submitted by Cllr. D. Doherty

 

(i)                 Did this Council erect the site guard around Hamilton Hall and if so are we leaving ourselves liable to injury claims?

 

The members were informed that this site guard was placed around the building to protect the public and prevent claims.

 

41/10            Correspondence

 

Correspondence received from Foroige asking that they make a presentation to the members at its next meeting.  This was agreed.

 

Correspondence received from Minister Mary Coughlan in relation to our letter re. Insurance Claims was read.

Correspondence received from Rehab re. Donegal Person of the Year Awards was read.

 

42/10            Suspension of Standing Orders

 

Cllr. Mc Eniff proposed the suspension of Standing Orders, this was seconded by Cllr. Mc Mahon.

 

            Cllr. Mc Eniff asked that stronger barriers be placed at the entrances into this Car Park so as to discourage overnight parking.   Cllr. Barrett felt that this was up to the Gardai to move these people along, and then they just move onto another area as no where to park legally.

 

Cllr. Mc Eniff asked what had been done re. his proposal to have a site at the Shore front.  Mr. Mc Nulty confirmed that this report has been given to members and the proposal contravenes the Bundoran Town Council Development Plan.

 

Cllr. Mc Intyre asked that the remainder of the meeting be held In-Committee to discuss Enforcement issues, this was seconded by Cllr. D. Doherty.

 

Cllr. Mc Intyre asked what the up to date position on the sign at Rockingham House.

 

Mr. Killian Smith, Enforcement Officer confirmed to the members that the Enforcement Notices were not complied with and a recommendation was being sent to the Town Manager, Mr. Sean Sheridan this week to recommend to institute legal proceedings.  Mr. Smith was hopeful that progress would be made by June regarding Court proceedings.

 

Cllr. D. Doherty asked if the legal proceedings were unsuccessful who would have to pay for legal bills, Mr. Smith confirmed Bundoran Town Council.

 

Cllr. Mc Eniff asked the situation with regards the jeep

 

Mr. Sheridan said he had spoken with the Barrister last Thursday and made it clear to him that the members were very keen to pursue, he felt this could be problematic, if we go ahead and not succeed the Council could be left in a very difficult position as a Corporate Body like Bundoran Town Council there is an onus on us to prove and sustain a case, and it would be very difficult and we don’t want to end up with “egg on our face”.

 

Cllr. Rafferty asked if one Councillor takes up a case.  Cllr. Mc Eniff confirmed that he was taking up a case and it was in the court a few weeks ago but the court ran out of time and was being rescheduled for June again.

Mr. Sheridan felt that if the Councillors wished to pursue this the Council would. Cllr Mc Eniff asked what the Barrister thought, Mr. Sheridan confirmed 50-50 chance.

 

Cllr. Barrett asked if the art work on the Protected Structure at Bayview Terrace required planning permission, to which Mr. Sheridan confirmed it did.

 

Mr. Smith also updated the members on the Star of the Sea Caravan Park saying that progress was ongoing and the works also required planning permission.

 

Cllr. Mc Glynn felt that he has multiplied x 4 of what was originally on the site and they were developing the entire site including where the Star of the Sea Guest House was situated.

 

The members were annoyed at the loss of car parking spaces at the Hamilton Hall a derelict building because of the netting.  Mr Mc Nulty said he would ask Donegal County Council to have a relook at this.

 

The members also queried the Derelict Site at the old O’ Gorman Arms site and felt there was a Health and Safety issue.  Mr. Murray confirmed that he had spoke to the owners and asked them to make site good.

 

Cllr. Mc Mahon advised him to write to the whole lot of them as ownership was in question here.
